MyChama Privacy Policy

MyChama is a one-stop-shop digital platform where chamas and groups can make all their transactions. It allows for transparency reduces human error, embezzlement or fraud, and time wastage. The App focuses on “small-scale chamas” or “groups,” eliminating ordinary meetings and cumbersome paperwork.

THE SCOPE OF DATA

When we refer to “we,” “us,” or “our,” we mean MyChama by Chamacom. When we refer to “you” or “your,” we mean the person accessing the site or using the App. If the person accessing the site does so on behalf of another person, including a business or other organization, “you” or “your” also means that other person, including a business organization. Suppose You provide us with personal information about someone else. In that case, You confirm that they are aware that you’ve provided their information and that they consent to our use of their information according to our Privacy Policy. You may opt-out at any time to prevent further use of the information shared via any of our Services.

This Privacy Policy applies to your use of our Services. It covers information collected in connection with your access to and use of our Services, including those Services provided through our sites and/or online. Please read this Privacy Policy carefully. By interacting with our Services, you consent to the practices described in this Privacy Policy. Please also read MyChama’s Terms of Service, which describes the terms under which you use our Services.

HOW WE COLLECT INFORMATION 

We want to inform you that your data are collected when:

• You register on our website, use it, or you use our MyChama app when you fill out all application forms or submit applications for our products or services provided on our website or MyChama App when you contact our employees or which are provided in any other way;
• You report a problem or communicate with us about our products or services;
• You participate in discussion groups or use social media such as Facebook, Instagram,
• You participate in our promotions actions, contests or surveys, or other activities provided through our websites or social media profiles.

INFORMATION WE COLLECT AND USE

1. Registration and Account Information: When you use the MyChama App, you voluntarily give us personal information (e.g., full legal name, national ID number (back-to-back), email address, profile photo, mobile number, date of birth, county and country, gender, and when necessary, billing information), and any other information you would provide to us. That means your name and photo (if you choose to provide them) will be visible to other MyChama App members, and they can search you by name, ID, phone number unless you change your settings. We may suggest you as a possible contact to people we believe you may know (without revealing your phone number) unless you turn off this option. When you install the MyChama App, you’ll also be asked to allow us access to your mobile device’s address book. A copy of the phone numbers will be used to create a new address number within the App, mainly for us to enable you and your contacts to connect.
2. Usage and Log Information: We may collect service-related, diagnostic, and performance information via the use of an API (Application Programming Interface). This includes information about your activity (such as how you use our Services, interact with others using our Services, and the like), log files, diagnostic, crash, website, and performance logs and reports.
3. Personal information: We use your contact information, such as your email address or phone number, to authenticate your account and keep it (and our services) secure and to help prevent spam, fraud, and abuse. We also use contact information to enable certain account features (for example, OTP verification codes) to send you information and personalize our services. If you provide us with your phone number, you agree to receive text messages from MyChama to that number as your country’s laws allow. You can choose to upload and sync your address book on MyChama to help you find and connect with people/groups you know and helps others find and connect with you. We also use this information to better recommend groups to you and others and to help others find your account if your settings permit, including through third-party services and client applications.
4. Transactional/Statement Information: If you pay or transact using our Services, we may receive information and confirmations, such as payment receipts, from other third parties processing your payment.
5. Device and Connection Information: We may collect device-specific information when installing, accessing, or using our Services. This includes hardware model, operating system information, browser information, IP address, mobile network information including phone number, and device identifiers for diagnostics and troubleshooting purposes, especially when you have trouble with our App’s features.

Uses and Retention

Our mission is to improve our Services and constantly provide you with new experiences. As part of this mission, we use your information for the following purposes:

1. Make our Service available: We use your Registration and Account information to (i) register you for the App and create your User Account for MyChama; (ii) create your profile and make it visible; (iii) create your MyChama unique system ID; (iv) provide customer service, give you information about your account, and respond to your requests; (v) indicate which of your contacts is already a MyChama member and notify you when your contacts become active on the Service; (vi) display the name of the contact as it appears in your address book when a call is received on the Service, and (vii) sync your contacts with MyChama running on Android mobile phones or tablets.If you deactivate your MyChama account, it will delete the address book from our servers (more about this below) quickly and permanently. Otherwise, we keep your contact information for as long as you use the App so we can provide you with all functions of the App.
2. Provide Interesting Offerings to You and others: As part of value-added services provided by us or by a third party within MyChama, we may use your information to optimize and personalize those services continuously. Then we’d send you personal updates about new offerings we believe you will find relevant. We may share with our service providers unique identifiers to determine the best way to tell potential new users about our services. When you join MyChama, the contacts in your address book that are already MyChama members may be informed that you’re now on MyChama too.
3. Prevent Fraud & Spam; enforcement of law: We really want MyChama to be free of spam and fraudulent content so that you feel safe and free. We may use your information to prevent, detect, and investigate fraud, security breaches, potentially prohibited or illegal activities, protect our trademarks and enforce our Terms & Conditions. This may include URLs in messages, which were reported as SPAM by other users, or otherwise suspected of being unsolicited and using your operating system authentication services. We may use automated decisions to close an account based on such data and other logic we have created for this in order to protect other users and prevent recurring breaches. 

Data Retention

Unless otherwise specified, we retain information as long as it is necessary and relevant for us to achieve the purposes referred to above or to enable us to comply with our legal data protection retention obligations. Upon deactivation of your account, we will minimize the personal data we keep about you only to such data that we must keep to comply with laws or other legal reasons. We may keep activity data on a non-identifiable basis to improve our services. Your posts on public accounts, communities, and channels may remain available if you do not delete them.

CONTACT INFORMATION

In situations where MyChama mobile applications (“MyChama Apps”) are acquired from other sources than Google Play, You may share the names, numbers, and email addresses contained in Your address book (“Contact Information”) with MyChama by enabling the MyChama Enhanced Search Functionality. The MyChama Apps are acquired from Apple App Store or Google Play; we do not share any user Contact Information.

We use cookies to operate and provide our Services, including our web-based Services, improve your experiences, understand how our Services are being used, and customize our Services. We may also use cookies to understand which of our FAQs are most popular and to show you relevant content related to our Services. You may provide us with Your user identifier information concerning, or allow Your usage of, certain third-party services (alongside a photo where applicable), e.g. social networking services and payment services, for the Services to integrate with such third party services. You also use such thirty party services to create Your user profile or log in to our services, share information with such third party services, or connect Your user profile with the respective third-party services. Similarly, the third-party services may automatically offer us access to certain personal information retained by them about You, and You agree that we may collect, use and retain the information provided by these third party services in accordance with this Privacy Policy.

 We work with third-party providers to help us operate, provide, improve, understand, customize, support, and market our Services. For example, we work with companies to distribute our apps, provide our infrastructure, delivery, and other systems, process payments, help us understand how people use our Services, and market our Services. These providers may provide us information about you in certain circumstances; for example, Safaricom may provide us with reports to help us diagnose and fix service issues.

We use all the information we have to help us operate, provide, improve, understand, customize, support, and market our Services.

1. Our Services: We operate and provide our Services, including customer support, and improving, fixing, and customizing our Services. We understand how people use our Services and analyze and use the information we have to evaluate and improve our Services, research, develop, test new services and features, and conduct troubleshooting activities. We also use your information to respond to you when you contact us. We use cookies to operate, provide, improve, understand, and customize our Services.

2. Safety and Security: We verify accounts and activity and promote safety and security on and off our Services by investigating suspicious activity or violations of our Terms and ensuring our Services are being used legally.

3. No Third-Party Banner Ads. We do not allow third-party banner ads on MyChama. We have no intention to introduce them, but we will update this policy if we ever do.

PERSONAL AND GROUP LOANS

We do not offer loans as a company, but groups registered to offer various public and individual loans linked to various groups. Under the chairmanship of the Chairperson, Secretary and Treasurer, the groups may opt to offer loans at their own given period, not less than one-month repayment with attached loan interest. 

DISCLOSURE

We may receive and/or collect information via an API (Application programming interface) and use the same to our website to operate and provide our Services, including when you install, access, or use our Services.

Due to the kind of information collected by us, the User should act in good faith, exercise reasonable care and diligence, and be solely responsible for the confidentiality of his account details, debit card details, OTP, PASSWORD, or PASSCODE and any personal information (“credentials”). The User acknowledges, represents and confirms that his credentials are personal to them. The User shall ensure at all times to keep the same confidential. We shall not be held liable or responsible if the User discloses his credentials to any third party in any manner whatsoever or authorizes any third party to operate an account or hands over their App or if third-party changes/modifies the credentials in the App or website due to disclosure of such credentials by the User or misuse of the application permitted by User to use by the third-party. Therefore, we shall not be held liable or responsible in case of any details including credentials and PASSCODE are compromised by User and/or any misuse of MyChama application by the third-party; in such case, the User shall be solely liable and responsible and shall keep MyChama indemnified, harmless and absolved from any liability in this regard including from any loss, cost, penalty, charges, including legal fees/charge, etc.; which may cause to MyChama due to User’s disclosure of his credentials/ PASSCODE to any third party/person or any misused thereof in any manner whatsoever including the misuse of MyChama Application by the third-party. The User shall be solely liable and responsible if the said details are compromised by the Customer knowingly or unknowingly, in any manner whatsoever.

Legality and Law

1. Legal Requests. Personal data transferred to us by you and/or our Partners may be subject to disclosure pursuant to legal requests or other judicial and government processes, such as subpoenas, warrants, or orders. Review the ‘Law and Protection’ section of the MyChama Privacy Policy for more information.

2. Law And Protection: We may collect, use, preserve, and share your information if we have a good-faith belief that it is reasonably necessary to: (a) respond pursuant to applicable law or regulations, to legal process, or to government requests; (b) enforce our Terms and any other applicable terms and policies, including for investigations of potential violations; (c) detect, investigate, prevent, and address fraud and other illegal activity, security, or technical issues; or (d) protect the rights, property, and safety of our users.

LICENSES

1. Your Rights. MyChama does not claim ownership of the information you submit for your account or through our Services. You must have the necessary rights to such information that you submit for your account or through our Services and the right to grant the rights and licenses in our Terms.

2. MyChama’s Rights. We own all copyrights, trademarks, domains, logos, trade dress, trade secrets, patents, and other intellectual property rights associated with our Services. You may not use our copyrights, trademarks, domains, logos, trade dress, patents, and other intellectual property rights unless you have our express permission except in accordance with our Brand Guidelines. 

3. Your License to MyChama. To operate and provide our Services, you grant MyChama a worldwide, non-exclusive, royalty-free, sub-licensable, and transferable license to use, reproduce, distribute, create derivative works of, display, and perform the information (including the content) that you upload, submit, store, send, or receive on or through our Services. The rights you grant in this license are for the limited purpose of operating and providing our Services (such as allowing us to display your profile picture, transmit your messages, store your undelivered messages on our servers for up to 30 days as we try to deliver them, and otherwise as described in our Privacy Policy).

4. MyChama License to You. We grant you a limited, revocable, non-exclusive, non-sublicensable, and non-transferable license to use our Services, subject to and in accordance with our Terms. This license is for the sole purpose of enabling you to use our Services in the manner permitted by our Terms. No licenses or rights are granted to you by implication or otherwise, except for the licenses and rights expressly granted to you.

MANAGING YOUR INFORMATION

If you would like to manage, change or limit, we allow you to do that through the Settings tool. You can change your Services settings to manage certain information available to other users, like changing your Mobile Phone Number, Profile Name and Picture, joining and leaving groups and membership of groups. You may delete your MyChama account at any time (including if you want to revoke your consent to our use of your information) using our in-app delete my account feature.

CHANGES TO THIS PRIVACY POLICY

We may revise this Privacy Policy from time to time as we add new features and services, as laws change and as industry privacy and security best practices evolve. We display an effective date on this Privacy Policy at the top of this Privacy Policy to make it easier for you to know when there has been a change. If we make any material change to this Privacy Policy regarding the use or disclosure of personal information, we will provide notice on our sites. Changes will apply to information collected after the change is effective. Please check this Privacy Policy periodically for changes. Small changes or changes that do not significantly affect individual privacy interests may be made at any time and without prior notice. Your use of the sites constitutes acceptance of the provisions of this Privacy Policy, and your continued usage after such changes are posted constitutes acceptance of each revised Privacy Policy.
